Recordals – an important part of working with intellectual property rights
With recordals, you can register various changes in ownership, such as recording transfers, mergers or other changes in connection with the transfer of intellectual property rights.
Chas. Hude has extensive experience with requesting and carrying out recordals, and our administrators are experts within this field.
In Denmark, there is no formal requirement to record changes in ownership at the Danish Patent and Trademark Office, just as there are no formal requirements in a large number of other EU countries. The national formality requirements for recordal procedures may therefore vary.
Although this is not a statutory obligation, we still advise all our clients to update the register. In addition to recordals giving you better visibility, an updated register can simplify any legal proceedings significantly, as recordals in this regard must otherwise be carried out urgently and thus may incur additional costs. The recordal itself has no effect on the legal ownership of your IPR, and you may be the legal owner of IPR even if this is not recorded in the register, but the burden of proof is simplified, if the register has been updated with the change in ownership. In addition, an updated register increases the value of your portfolio. In particular, this will save a potential acquiror the burden of recording the various stages in the development of the portfolio before they become the owner themselves.
